Terms of Service

PLEASE CAREFULLY READ SECTION 15 ("DISPUTE RESOLUTION AND ARBITRATION AGREEMENT"). IT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

This document is an electronic record in terms of the Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the Kaampy platform.

Welcome to Kaampy. These Terms of Service ("Terms") govern your access to and use of the Kaampy mobile application, website, and related services (collectively, the "Platform"), operated by Kaampy Private Limited ("Kaampy," "Company," "we," "us," or "our").

By registering an account, verifying your phone number via OTP, accessing or using the Platform, you agree to comply with and be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

1. Platform Overview & Nature of Service

Kaampy is a mobile-first online marketplace connecting independent service providers, freelancers, and professionals ("Takers" or "Find Work Mode") with clients, businesses, and individuals seeking to hire ("Givers" or "Hire Talent Mode").

Independent Contractor Relationship:

Kaampy is strictly a technology platform and an intermediary. We do not provide the services offered on the Platform. "Takers" operate as independent contractors. No agency, partnership, joint venture, employer-employee, or franchiser-franchisee relationship is intended or created by these Terms. Kaampy is not a party to any verbal or written agreement entered into between a Taker and a Giver.

2. Account Registration & Eligibility

  • Eligibility: You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872, to use Kaampy. Minors may not use the Platform. We monitor for underage use and will terminate, suspend, or ask you to verify your Account if we have reason to believe that you may be underage.
  • Registration: Registration involves authentication via a valid Indian mobile number and One-Time Password (OTP). You agree to provide accurate, current, and complete information during onboarding (including location, skills, and mode preferences) and to update such information to keep it accurate. You cannot allow another person to use your Kaampy account or share your account without permission.
  • Account Security: You are responsible for all activities that occur under your account. You must notify Kaampy immediately of any unauthorized use or security breaches.

3. User Modes: Taker and Giver

Every registered user has access to two distinct modes on the Platform, which can be toggled via Settings.

Taker (Find Work)

Users can browse job listings, apply to jobs, and connect with potential clients.

Giver (Hire Talent)

Users can post job listings, browse professional provider profiles, and shortlist candidates.

Users acting in either capacity must adhere to professional conduct, honor agreed-upon budgets and timelines, and not engage in discriminatory, abusive, or fraudulent behavior.

4. Subscription Plans, Payments, and DM Credits

Pricing Tiers & Auto-Renewal

Kaampy offers Free, Pro, and Ultra subscription plans. All pricing, limits (e.g., active applications, active chats), and premium features are subject to change.

Auto-Renewal:

If you purchase an automatically renewing subscription (e.g., weekly or monthly), your subscription will automatically renew at the end of the period unless you cancel it. To avoid charges for a new subscription period, you must cancel before the end of the current period. Deleting your account or the app from your device does not automatically cancel your subscription.

Purchasing & Third-Party Processors

Payments are processed via third-party payment gateways (e.g., Razorpay) or through third-party platforms like the Apple App Store or Google Play Store ("Third Party Store"). By making a payment, you agree to the terms and conditions of Kaampy’s payment processor or the Third Party Store.

DM Credits as Virtual Items

  • DM Credits reflect a limited, personal, non-transferable, revocable license to access premium messaging features. They do not constitute a real-world balance or stored monetary value.
  • No title or ownership in or to DM Credits is transferred to you. You may not sell, redeem, or otherwise transfer DM Credits.
  • All purchases of DM Credits are final and non-refundable.

Refunds & Cancellations

Generally, all charges for purchases are non-refundable, and there are no refunds or credits for partially used periods, unless explicitly mandated by applicable Indian law (such as the Consumer Protection (E-Commerce) Rules, 2020). If you cancel a subscription, you will retain access to the premium features until the end of your billing cycle.

5. Trust, Verification, and Background Checks

  • User Verification: Kaampy encourages a safe community by offering phone and photo verification.
  • Background Checks: In certain circumstances (such as responding to user/press reports of misconduct), Kaampy reserves the right to use available public records, court records, or third-party background check services to investigate whether a user has a criminal history. If we determine a user has been convicted of violent offences, fraud, sexual offences, or other severe crimes, we may block that person from the Platform.

NO GUARANTEE OF SAFETY

While we conduct verification and potential background checks to the best of our ability, Kaampy DOES NOT guarantee the absolute identity, background, criminal history, or safety of any user. Users interact and meet with one another AT THEIR OWN RISK. Givers must perform their own due diligence before hiring, and Takers must exercise caution before accepting a job.

6. Matching, Communication, and Conduct

  • Matching Mechanism: Direct communication (Chat) is unlocked only when there is mutual interest (a "Match") or by spending DM Credits to message non-matched users.
  • Code of Conduct: You agree to use Kaampy's messaging system solely for discussing jobs and professional networking. You shall not use the chat to:
    • Send spam, phishing links, or unsolicited promotions.
    • Send abusive, defamatory, harassing, sexually explicit, or obscene content.
    • Extort users or solicit transactions strictly outside the platform to defraud Kaampy or violate safety guidelines.
    • Submit appeals, reports, or complaints that are manifestly unfounded or purely malicious.

Kaampy reserves the right to review chats reported for abuse and suspend accounts violating this policy.

7. User-Generated Content

By posting jobs, uploading profile photos, listing services, or sending messages ("User Content"):

  • You grant Kaampy a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your User Content for the purpose of operating, marketing, and improving the Platform.
  • You warrant that you have all necessary rights to your User Content and that it does not infringe on any third party’s intellectual property, privacy, or other rights.
  • No Obligation to Pre-Screen: While we do not pre-screen all User Content, we reserve the right to review, pre-screen, refuse, and/or remove any User Content, including content exchanged in direct messages, to keep our members safe.

8. Prohibited Categories and Illegal Activities

You may not use the Platform to post jobs or offer services that involve:

  • Illegal, fraudulent, or dangerous activities under Indian law.
  • Escort services, prostitution, or sexually explicit services.
  • Sale of illegal drugs, weapons, or contraband.
  • Scraping, crawling, or copying profiles/data automatically.

Kaampy reserves the right to remove non-compliant jobs and terminate accounts immediately.

9. Disputes Between Users & Release

  • As Kaampy is not a party to the transactions between Givers and Takers, any disputes regarding service quality, payment for jobs, delays, or damages must be resolved directly between the respective Giver and Taker.
  • You agree to release Kaampy (and our officers, directors, affiliates, and employees) from any claims, demands, losses, damages, rights, and actions of any kind, including personal injuries, death, and property damage, that directly or indirectly arise from your interactions with or conduct of other users of the Platform.

10. Third Party App Store

If you download the App from a Third Party Store (like Apple App Store or Google Play Store):

  • These Terms are concluded solely between you and Kaampy, not with the providers of the Third Party Store. Kaampy is solely responsible for the App.
  • The Third Party Store provider has no obligation to provide maintenance and support for the App.
  • The Third Party Store provider and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you.

11. Disclaimer of Warranties

YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. THE PLATFORM AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KAAMPY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KAAMPY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE, OR THAT YOUR MATCHES WILL BE COMPATIBLE OR SUCCESSFUL.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAAMPY PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR OTHER USER ON THE PLATFORM;
(C) ANY JOB PERFORMED OR FAILED TO BE PERFORMED; OR
(D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL KAAMPY’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM EXCEED THE AMOUNT YOU PAID KAAMPY, IF ANY, IN THE LAST SIX (6) MONTHS PRIOR TO THE DISPUTE, OR ₹3,000 INR, WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless Kaampy Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Termination

Kaampy may suspend or terminate your account and your access to the Platform at any time, for any reason or no reason, without notice. If we determine that you have violated these Terms, your conduct is inappropriate, or you pose a risk to the community, we may immediately deactivate your account, delete your User Content, and discontinue your subscriptions without refund. Upon termination, all provisions which by their nature should survive (including Arbitration, Disclaimers, and Limitation of Liability) shall survive.

15. Dispute Resolution and Arbitration Agreement

Please read this Section carefully. It limits how you can seek relief from us.

  • Informal Resolution:

    Before initiating any formal proceedings, you and Kaampy agree to meet and confer via teleconference or videoconference in a good faith effort to informally resolve any claim or dispute. You must send a detailed written "Notice of Dispute" to our Grievance Officer at least 60 days before initiating arbitration.

  • Binding Arbitration:

    Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, that cannot be resolved informally, shall be resolved by binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a single arbitrator appointed mutually by Kaampy and you.

  • No Class Actions:

    ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT ON A CLASS OR COLLECTIVE BASIS. YOU GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR ANY OTHER CLASS PROCEEDING.

  • Jurisdiction:

    The seat and venue of arbitration shall be Noida, India. Subject to the arbitration agreement above, the designated courts of Noida shall have exclusive jurisdiction.

17. Modifications to the Terms

Kaampy reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Platform or notifying you via email/in-app notification. Your continued use of the Platform following any modifications indicates your acceptance of the updated Terms.
